This terms of use document is a non-binding translation of the German version.
1) Introduction and Scope
1.1 These Terms of Use apply to the use of the Symptolog website as well as the Symptolog app (Android, iOS, and Windows).
1.2 By using our website or app, you agree to these Terms of Use.

2) General Usage Guidelines (Website & App)
2.1 Symptolog may only be used for private or professional informational and documentation purposes.
2.2 It is prohibited to use the services in an abusive, unlawful manner or in any way that impairs operation, security, or availability.
2.3 Automated use, content extraction (scraping), reverse engineering, manipulation, or circumvention of technical safeguards is not permitted.
3) Content and Copyright
3.1 All provided content, including questionnaires, texts, structures, evaluations, designs, and graphics, is protected by copyright law.
3.2 The content may be used privately as well as professionally or therapeutically (e.g. by psychologists, physicians, therapists, or coaches).
3.3 Publication, reproduction, systematic distribution, sublicensing, or independent commercial use without prior explicit permission is not permitted.
4) Use of the App (Additional Provisions)
4.1 Local data storage:
All personal health and symptom data is stored exclusively locally on the user’s device. No data is transmitted to external servers or cloud services without the user’s active action or consent.
4.2 Data transmission with user consent:
Personal data is transmitted only if the user expressly consents to a corresponding function, in particular when sharing data, creating reports, or storing data in a cloud service of the user’s choice.
4.3 Cloud backups:
The app may store backups in various cloud services (e.g. Google Drive). A cloud backup is performed only with the user’s active consent and requires a connection to the respective cloud service.
4.4 Automatic backups:
If the user activates the “automatic backup” function, backups are created automatically at intervals defined by the user. This function can be deactivated at any time.
4.5 Location and weather data:
For weather-related functions, the app may use location information. The user decides whether to enter a location manually (e.g. postal code) or grant GPS access. Without consent, no location data is processed.
4.6 Permissions:
The app only requests permissions that are necessary for the respective function. If a permission is not granted, the corresponding function cannot be used.
4.7 Device-dependent risks:
Functionality may vary depending on the device, operating system, or third-party software used. We assume no liability for resulting limitations or data loss.
5) Use of the Website (Additional Provisions)
5.1 The website is provided for informational purposes only and does not process personal health data.
5.2 Functions such as symptom tracking, backups, or location processing are available exclusively within the app.
6) Availability
6.1 We strive to ensure high availability but do not guarantee uninterrupted or error-free operation at all times.
6.2 Maintenance, technical issues, or external factors may temporarily restrict availability.
7) Disclaimer
7.1 The provided content is intended solely to support self-observation and does not constitute a medical diagnosis or treatment.
7.2 Use of the services is at your own risk. Liability for damages or data loss is excluded to the extent permitted by mandatory statutory provisions.
7.3 Use of Symptolog does not replace consultation with a physician, psychologist, or therapist, nor professional medical or psychotherapeutic treatment.

8) Changes to the Terms of Use
8.1 We reserve the right to amend these Terms of Use at any time.
8.2 The version valid at the time of use shall apply.

We reserve the right to restrict or terminate access to the website or app, in whole or in part, in the event of violations of these Terms of Use.
10) Applicable Law
The law of the Federal Republic of Germany shall apply. Mandatory consumer protection provisions remain unaffected.
